By completing the sign-up form and providing your digital signature, you (“Renter”) agree to the following terms and conditions for the lease of a freshwater boat slip from Old Canal Marina, LLC, d/b/a Hidden Cove Marina (“Marina”), located at 547 Reid Hill Road, Moncks Corner, SC 29461.
1. Rental Term, Rate & Payment
The Renter agrees to one of the following lease terms based on the assigned slip size. Each lease will automatically renew for the same consecutive term unless terminated by the Marina or Renter as outlined in the Termination clause below.

2. Parking
The parking area for Boat Slip Owners is limited to one vehicle per slip. The Marina will issue one (1) parking pass which must be visible from the outside of the vehicle at all times. The fee for a lost or damaged parking pass is $75.00. No trailers may be left in the parking area; towing is strictly enforced.
3. Insurance
The Renter warrants that they will maintain, at all times, watercraft liability/protection insurance and hull insurance for the full market value of the watercraft. Upon request, the Renter must provide the Marina with Certificates of Insurance evidencing this coverage and naming the Marina as an additional insured party.
4. Adverse Weather Conditions
The Marina is not responsible for any damage to the Renter’s boat from storm, hail, hurricane, or any other force of nature. In the event the Renter’s boat appears to be a threat to person or property, the Marina may take emergency action, including but not limited to preparation or salvage work, at its sole discretion. The Renter holds the Marina harmless for any damage done to the boat during such emergency action and indemnifies the Marina and its agents from any and all claims, damages, and liabilities arising out of the Renter’s boat during a storm or hurricane.
5. Boat Condition & Operation
The Renter’s boat must be kept in good condition and be capable of safe maneuvering and self-propulsion with an operable engine. If requested by the Marina, the Renter will demonstrate the mobility of their vessel to the Marina’s satisfaction.
6. Marina Rules & Regulations
The Renter, their agents, employees, guests, and licensees shall comply with all applicable laws and ordinances, as well as all Hidden Cove Marina Rules and Regulations. Any breach of these rules shall be considered a breach of this agreement.
7. Ownership, Assignment & Use
The Renter may not assign this agreement or sublet the Boat Slip without the express written permission of the Marina. Residence on the boat is not permitted. The Renter must advise the Marina of any legal change of ownership or rental of the boat within twenty-four (24) hours of such a change.
8. Changing Boat Slips & Boat Removal
The Marina may, without notice to the Renter, change the location of the Boat Slip to another Boat Slip of comparable size. In such an event, the Marina will promptly notify the Renter of the change. If the Renter breaches this Agreement and fails to remove the boat from the slip within the time specified in a written notice, the Marina may remove the boat from the Harbor to a location of its choosing, including offshore mooring, without any liability to the Marina.
9. Termination
Termination by Marina: The Marina may terminate this agreement upon (i) breach of this Agreement by the Renter, his agents, or guests; (ii) misrepresentation by the Renter; (iii) failure to pay any sum when due; or (iv) thirty (30) days’ written notice to the Renter.
Termination by Renter: The Renter may terminate this agreement upon (i) thirty (30) days’ written notice to the Marina, or (ii) the Boat Slip becoming unserviceable.
Early Termination Penalty: If the Renter terminates this agreement before the end of the selected term, the Marina is entitled to two (2) months’ rent at the specified rental rate.
Furthermore, the Renter warrants they will not rent, use, or occupy a Boat Slip from any agent or owner other than the Marina for a period of sixty (60) days from the termination of this Agreement.
10. Default & Legal Action
Upon any default, the non-breaching party may pursue all remedies provided herein or by law. In any legal action, arbitration, or lawsuit to enforce the terms of this agreement, the successful party shall be entitled to collect from the unsuccessful party all costs of enforcement, including court costs and reasonable attorney’s fees.
11. Live Aboard
Live aboards are not permitted. No persons are permitted to stay overnight on any vessel for any period of time without prior written approval from the Marina.
12. Contractors
The Renter agrees not to employ a contractor for work on their vessel unless that contractor has general liability insurance coverage of at least $1,000,000 aggregate and $500,000 for each incident of property damage or personal injury. All contractors must check in at the Marina office prior to any evaluation or performance of work.
13. Waivers
Waiver of Trial by Jury: The Marina and Renter hereby waive the right to a trial by jury in any action, proceeding, or counterclaim brought by either party in connection with this Agreement.
No Waiver: No waiver or breach of any covenant, condition, or agreement shall operate as a waiver of the covenant, condition, or agreement itself, or any subsequent breach thereof.
14. Governing Law
This Agreement shall be construed and governed by the laws of the State of South Carolina. Should any provision of this Agreement be illegal or unenforceable, the remaining conditions shall remain in full force and be binding upon the parties.
